Rideshare and delivery companies want the Biden administration's nominee for the Department of Labor to clarify her position on an incoming worker-classification rule that could expand workers' rights, a trade group representing the companies said on Monday. The Department of Labor in October proposed a rule that would make it more difficult for companies to treat workers as independent contractors, which would shake up ride-hailing, delivery and other industries that rely on gig workers. The Flex Association, which represents companies such as Uber and Lyft, sent a letter to Biden on Monday asking that his nominee to lead the U.S. Department of Labor, Julie Su, explain how she would implement the proposed rule in a "manner that protects independent work."

Shares of Uber Technologies Inc. (UBER) Lyft Inc. (LYFT) and DoorDash Inc. (DASH) ended higher Tuesday, a day after a California appeals court handed them a partial victory that lets them continue treating their drivers and couriers as independent contractors instead of employees — though an appeal to the California Supreme Court is likely. The three-member appeals court ruled two to one that most of Proposition 22, the law that came out of a 2020 ballot initiative on which the companies spent more than $200 million, could be upheld after a judge last year declared it unconstitutional.

The Consumer Price Index (CPI) rose 0.4% in February, easing slightly from a 0.5% gain in January as energy prices declined 0.6%. The core CPI, which excludes volatile food and energy prices, rose 0.5% in February and was up 5.5% from a year ago, marking the smallest 12-month increase since September 2021. Confidence among small business owners about business conditions edged up in February, though rising prices continued to weigh on sentiment, according to the National Federation of Independent Business (NFIB).

A California appeals court decision preserves the companies’ independent-contract model in the state and could bolster their efforts elsewhere.
App-based ride hailing and delivery companies like Uber and Lyft can continue to treat their California drivers as independent contractors, a state appeals court ruled Monday, allowing the tech giants to bypass other state laws requiring worker protections and benefits. The ruling mostly upholds a voter-approved law, called Proposition 22, that said drivers for companies like Uber and Lyft are independent contractors and are not entitled to benefits like paid sick leave and unemployment insurance. A lower court ruling in 2021 had said Proposition 22 was illegal, but Monday's ruling reversed that decision.
